Does the tenant not want to move in after all?

The tenant is initially obligated to pay rent throughout the notice period, even if they change their minds or have other plans.

If the tenant does not want to move in due to serious defects with the residence, they can consider terminating the contract with immediate effect.

The requirement for terminating the contract with immediate effect is that there is a serious breach. The tenant should secure evidence for the breach of contract.

Examples on serious breaches of contract can be that the landlord has not handed over the residence with keys at the beginning of the tenancy, that the landlord refuses to accept the rent paid to a bank account, or that the residence is not approved for housing.

There is a very high threshold for terminating the contract with immediate effect. Wrongful termination can lead to liability. Ordinary termination by giving notice is often an alternative.
