Damage that occurs during the tenancy

In some cases pest and vermin can infest the property. This can be rats or bed bugs.

There can be different reasons for the infestation.

It can for example be that the tenant brought bed bugs onto the property after being on vacation. When this happens it is the landlord that must implement means to remove the pest or vermin. The tenant risk having to cover the landlords cost of remediation.

If however, the bed bugs came through the wall of a different apartment in the building, it will initially be the landlord's responsibility to remove the vermin. Whether the tenant is liable in this circumstance will depend on if the tenant is responsible for the bed bugs coming into the apartment.

Both the tenant and the landlord has a maintenance obligation. What is agreed upon regarding this obligation will be relevant for who has the responsibility for pest and vermin.

Even if a defect, like bed bugs on the property, is a result of circumstances on the tenant's part, it is the landlords that must ensure repairs.

The tenant may still be responsible for the landlord's financial loss following the damage.
