What does the contract say?

What rights the tenant has to terminate is often written in the contract.

Time specified and unspecified tenancy agreements

The tenant can terminate an unspecified tenancy agreement, unless otherwise agreed upon.

The tenant can terminate a time specified tenancy agreement if it is agreed upon, or if the landlord has not informed the tenant in writing that the contract cannot be terminated.

How should the notice of termination be given?

The tenant can give notice to terminate the tenancy verbally or in writing, and they do not need to give a reason for terminating.

Unfortunately the lack of written evidence can create challenges if the parties come to a disagreement. Without written evidence it can be hard to win a case in the Rent Disputes Tribunal. To prove that the contract is terminated, it can be wise for the tenant to give notice in writing.

It is permitted to agree on other solutions

It is permitted for the landlord and tenant to agree on other solutions, for example that the contract cannot be terminated the first year of the tenancy, or that the contract can only be terminated for specific reasons.
